These Terms of Service ("Terms") govern your use of the CityPirate mobile application ("the App") operated by Florian Pascal Abel, Barcelona, Spain ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.
You must be at least 18 years old to use CityPirate. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts if we have reason to believe the user is under 18.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to keep it up to date.
You may delete your account at any time from within the App (Settings). Account deletion is subject to a 90-day grace period during which you can cancel the request. After 90 days, your personal data will be permanently anonymized or deleted in accordance with our Privacy Policy.
Ownership: you retain ownership of all content you create or upload through the App, including tips, photos, check-ins, and other contributions ("User Content").
License: by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, display, reproduce, distribute, adapt, and modify your User Content for the purpose of operating, improving, and promoting the CityPirate service. This license continues even if you delete the specific content or your account.
Content after account deletion: when you delete your account, your personal data (name, email, profile) is erased in accordance with our Privacy Policy. However, User Content you contributed (such as tips, photos, and check-ins) may remain on the platform in anonymized form — meaning it will no longer be attributed to you or linked to any identifiable account. This ensures that community contributions continue to benefit all users.
Responsibility: you are solely responsible for your User Content. You represent and warrant that you have the rights to post it and that it does not violate any third party's rights or applicable law.

We reserve the right to review, remove, or restrict any User Content at our sole discretion, without prior notice, if we believe it violates these Terms or is otherwise harmful. Users can report content using the report function available on all user-generated content within the App.
When we remove content or restrict your account, we will provide a brief explanation of the reason, unless doing so would compromise safety or legal obligations.
The CityPirate name, logo, design, and all proprietary content (excluding User Content) are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content without our prior written consent.
CityPirate provides information about places and events sourced from various public and third-party sources, as well as from community contributions. We do not guarantee the accuracy, completeness, or timeliness of this information, including but not limited to opening hours, prices, event dates, or venue availability.
You should independently verify any information before relying on it, especially for time-sensitive decisions.
We may suspend or terminate your account if:

CityPirate is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's availability, reliability, accuracy, or fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages arising from reliance on place or event information, loss of data, or service interruptions.
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
The App may contain links to or integrate with third-party services (e.g., map providers, external websites linked from places or events). We are not responsible for the content, privacy practices, or availability of these third-party services.
We may update these Terms from time to time. We will notify you of material changes through the App or via email at least 30 days before the new Terms take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms or your use of the App shall be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
